§ 1 Subject of Contract

This license agreement governs the use of the software solution "GastroFox" (hereinafter "Software"), which is provided by the Provider to the Licensee as a download.

§ 2 License Grant

With the purchase, the customer (Licensee) receives the non-exclusive, non-transferable, and unlimited usage right to install and operate the software on a single domain.

The domain must be specified at the time of purchase and will be documented in the license.

Use on multiple domains or in multi-tenant systems is only permitted with the express written consent of the Provider.

§ 3 License Restrictions

The Licensee is prohibited from:

• reselling, renting, or making the software publicly available;
• using the software on additional domains or subdomains without authorization;
• circumventing or removing protection mechanisms of the software;
• decompiling, modifying, or otherwise reverse engineering the source code, unless expressly permitted by law.

§ 4 Domain Tracking / Call-Home Function

For license monitoring, the software may regularly transmit the used domain and IP address to the Provider's license server during operation ("Call-Home").

No personal data is transmitted.

The Licensee expressly agrees to this measure.

§ 5 Ownership and Copyright

The software remains the intellectual property of the Provider. The Licensee does not acquire ownership, but only the usage right defined in § 2.

§ 6 Contract Violation

In case of violation of this license agreement, the Provider is entitled to:

• revoke the license with immediate effect;
• initiate legal proceedings;
• claim damages.

§ 7 Final Provisions

Changes or additions to this license agreement require written form.

German law applies. The place of jurisdiction is, where permissible, the Provider's registered office.

Should individual clauses be invalid, the validity of the remaining provisions remains unaffected.
